Background Information: Person X complained to the Council that it had failed to take into account her personal circumstances, and based on these circumstances, should have provided them with a mooring licence. The complaint was considered at each of the three stages of the Council's corporate complaints procedure, where it was not upheld. Person X then took it to the Local Government Ombudsman (LGO) who reviewed and upheld the complaint. In upholding the complaint, the LGO required the Council to consider Person X’s personal circumstances during its welfare assessment; and if it decided Person X’s circumstances were exceptional enough not to take enforcement action, the Council should go on to consider if the circumstances warrant a departure from its moorings policy and offer them a licence. The LGO required the Council to take this required action, and provide detailed reasons for its decision to Person X and the Ombudsman, within three months of the LGO's final decision.
