Councillor McPherson was appointed as Chair for the meeting.

 

No declarations of interest were made.

 

All parties noted the procedure. 

 

The Licensing Officer presented their report.

 

Representation from the Applicant and his Representative

 

The Applicant and his  Representative then gave their report highlighting the following areas:

 

·      The application was to vary the supply of alcohol only (for consumption on and off the premises only) from Monday to Sunday between the hours of 10:30 and 23:00, and

·      Recorded Music Monday to Sunday between hours of 09:00 to 23:00

·      Previous business experience.

·      The provision of staff training with a training programme already in place.

·      There was a currently a Tesco and a Snooker Club in the vicinity that had a premises licence.

·      He had the same landlord as Tesco.

·      He wanted to sell Italian beer and other high end products such as coffee, cheese and paninis.

·      The objection was from a school as they had concerns with the sale of alcohol at school opening/closing times.

 

In response to questions the Applicant said the following:

 

·      The applicant already had  training programme in place.

·      He was aware of current laws and regulations pertaining to Premises Licences.

·      Security would be available seven days a week during evening periods.

·      Offsales would only be available in sealed containers if a customer bought other products.

·      CCTV was installed on the property

 

Summing up.

 

The Officer reminded Members they were to determine the application on its individual merits having reference to the statutory licensing objectives and Cambridge City Council’s Statement of Licensing Policy and the Cumulative Impact Assessment.

 

Members should take such steps that they consider were necessary for the promotion of the licensing objectives. The subcommittee may resolve:

 

a.    To grant the variation as applied for.

b.    To modify the conditions of the licence.

c.    To reject the whole or part of the application.

 

Members must give reasons for their decision.

 

In making the decision the committee considered the following:

·      Advice from Legal Officer

·      Representations from those listed above.

The Decision

 

The Committee made the following findings of fact:

 

1.             The applicant had amended opening hours to run from 10.30hrs until 22.30hrs Mon – Sat and 10.30hrs to 21.30hrs on Sunday, which addressed committee concerns and the element of the objection from the member of the public relating to excessively long hours.

 

2.             Applicant had met all the safety and licensing requirements and agreed additional conditions with the responsible authorities.

 

3.             The applicant had extensive licensing experience within Cambridge, which has been managed well.

 

Resolved: To GRANT the license with the amended licensing hours of 10.30hrs until 22.30hrs Mon – Sat and 10.30hrs to 21.30hrs on Sunday.

 

Our reasons for reaching the decision are as follows:

 

1.             The applicant has met all the safety and licensing requirements and agreed additional conditions and has addressed concerns over licensing hours. The Committee are also satisfied that the granting of the license will not have an adverse effect on the Cumulative Impact Area.
