Minutes: The Licensing
Officer presented the report and outlined the application to vary a Premises
Licence under section 34 of the Licensing Act 2003 in respect of Calverley’s
Brewery Limited, 23a Hooper Street, Cambridge CB1 2NZ. The Licensing
Officer made the following points: ·
the
premises were not located within a cumulative impact area; ·
the
Premises Licence had been in effect since 03/11/14; ·
the
premises had reached their limit of 15 Temporary Event Notices for 2016; ·
a complaint had been received by one resident
in regard to the Temporary Event Notices.
However, this was made after the event, and no calls had been made to
the out of hours noise service; ·
an out of hours officer did visit the premises
on 07/05/16 when a Temporary Event Notice was taking place. The officer did not witness any excessive
noise or any other issues. Mr Calverley made
the following points as Applicant: ·
outlined
the nature of the business, the premises and neighbouring properties; ·
highlighted
the favourable comments that had been received; ·
outlined
the Brewery’s recycling policies and advised that staff regular litter pick; ·
explained that whilst the
majority of their customers were local people who walked or cycled to the
brewery, there was parking available on site, for customers to collect. Members’ Questions In response to a
Member question, the applicant confirmed that approximately 28-30 people could
be accommodated within the Brewery, and around the same number outside. The Sub-Committee
received a presentation from a local resident, Sally Collins-Taylor, who was
objecting to the variation. In her
presentation, she highlighted specific problems her family experienced as near
neighbours to the Brewery, particularly with the Events, including catering
vans, parking issues, noise and litter.
She quoted specific incidences, and the negative impact that this had
had on her family and immediate neighbours.
The operating hours of the other businesses in the Yard, and the nature
of those businesses, meant that they did not cause a disturbance. Arising from
questions, Ms Collins-Taylor confirmed that she had not reported the incidents
of disturbance to Environment Health. Members reminded
those present that because the premises were outside of the community impact
zone, the 2003 Act made a presumption that applications/ variations should be
agreed unless there were exceptional circumstances. Members withdrew
at 10:35am and returned at 11:15am. Whilst retired and having made their decision,
Members received assistance on the wording of the decision by the Legal
Advisor, but no legal advice was provided. Decision: The Sub-Committee
decided to grant the variation of licence as applied for. The Sub Committee
provided the following reasons for their decision: 21 representations had been received from Other Persons, 19 in support
of the application and 2 opposing the grant of the application. The representations raised by those opposing
the application were not relevant to the licensing objectives and could not be
taken into account when determining the application. |
