The Committee received a report from the Senior Technical Officer to consider CAB23’s first renewal application for a Private Hire Operator’s Licence to operate Private Hire Vehicles licensed by Cambridge City Council.

 

The Senior Technical Officer clarified that Appendix 2 referred to in paragraph 3.6 of the officer’s report should refer to Appendix 3.

 

Member Questions

i.               Asked whether a speeding offence could be taken into consideration when deciding whether to renew CAB’s Operator’s Licence.

 

The Legal Officer responded:

        i.                      Confirmed that the speeding offence could be taken into consideration, he also noted that no action had been taken against the driver regarding the speeding matter  and this could also influence their decision.

 

Mr Tsakanikas confirmed:

        i.                      He had been a taxi driver for many years and had lots of experience dealing with members of the public.

      ii.                      Their business mainly focussed on the Cambridge to Cambourne route, they did not usually take fares around Cambridge.

    iii.                      CAB23 had a certificate from the Information Commissioner to process personal data. This was a requirement under South Cambridgeshire District Council’s licensing conditions.

    iv.                      The speeding offence occurred in 2018 on the A14 when road works were taking place and the speed limit on the A14 was reduced to 40mph.

      v.                      He drove very carefully as driving was his living.

    vi.                      He appealed the speeding offence as he had a witness, a passenger in the car at time. The witness was unable to attend the Magistrates Court when the case was heard as the case was heard in Peterborough and not Cambridge

  vii.                      He was given 6 points on his driver’s licence rather than the more common award of 3 points.

 

Members withdrew at 11:45 am and returned at 11:53 am.

 

Decision

The Sub Committee resolved to renew the Operator’s Licence for one year.

 

Reasons for reaching the decision were as follows:

  • Mr Tsakanikas was considered to be a fit and proper person to hold an Operator’s Licence. The six points on his licence were explained satisfactorily and members considered them not to be relevant due to the exceptional circumstances explained at the meeting.
